Fluffer by Motorbunny

Fluffer Terms of Service

Effective date: [To be confirmed]

These terms are an agreement between you and MB Technologies LLC, the company behind Fluffer by Motorbunny ("MB Technologies", "we", "us"), for your use of the Fluffer app, the Fluffer website (fluffer.app), the Fluffer Store and related services ("Fluffer"). You accept them when you tap "I agree" or "Continue as guest" after being shown them, or when you create an account. Our Privacy Policy explains how we handle your information. If you don't agree, please don't use Fluffer.

Please read section 17, "Disputes and arbitration". If you live in the US, it requires most disputes to be decided by individual arbitration, not in court, and waives class actions.

#The short version

#1. Who can use Fluffer

You must be at least 18 years old, and old enough to view adult content where you live. You must be able to make a binding agreement, and you must not be barred from using Fluffer by law or by an earlier suspension. Don't use Fluffer where adult content or connected toys aren't allowed. We may ask you to confirm your age, and we may close accounts we believe belong to someone under 18.

#2. Your account

Give accurate information, keep your password and phones secure, and tell us if you think someone else is using your account. You're responsible for what happens under your account. One person per account. Usernames must not impersonate anyone or be offensive, and we may change or reclaim a username that breaks these terms.

#3. Using toys safely

Fluffer is software that sends commands to Bluetooth toys and to your phone's vibration motor. It isn't a medical device and isn't meant to diagnose, treat, cure or prevent any condition.

#4. Risks you accept

Using intimate devices, alone or with others, and letting other people, viewers, games, AI features or code control them, has risks that can't be removed completely. These include discomfort, skin irritation, bruising, overuse injury, unexpected starts, embarrassment and emotional distress, and the fact that wireless connections are never perfectly reliable. You understand these risks and choose to accept them.

To the fullest extent the law allows, you release MB Technologies LLC and its affiliates, officers, employees and agents from claims arising from (a) those risks and (b) what other users, viewers, tippers, toy makers, third-party developers, Chaturbate, or code or AI assistants you connect do or fail to do. This release doesn't cover claims arising from our gross negligence, recklessness, willful misconduct or fraud, or any claim the law doesn't allow to be released. For claims under clause (b) only, if you live in California, you waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You also waive any similar law elsewhere.

Only let people control your toy if you want them to, and only control someone else's toy with their clear yes, which they can take back at any time. When someone else controls your toy, you start or approve the session, it ends after 30 minutes, your power limits still apply, and you can press Stop at any time. Treat share links and remote-control invitations like keys: anyone who has one can use it until it expires or you revoke it. Never involve anyone under 18 in any way. Controlling someone's toy without their consent may be a crime, and we may report it and cooperate with law enforcement.

#6. Streaming and tips

Tip4Fuel works with your Chaturbate room. You're responsible for following Chaturbate's terms and the laws that apply to your stream, and for how tips and tippers' information appear on your stream. Chaturbate is a separate company, and we aren't responsible for it, for tips, payments or payouts, or for your room. Fluffer doesn't process payments and isn't a party to any tip. Fuel, patterns and vibration in response to tips are entertainment features with no cash value.

#7. Community rules

Follow our Community Guidelines, which are part of these terms. In particular, don't use Fluffer to:

We have zero tolerance for objectionable content and abusive users. We may remove such content and ban such users without notice.

#8. Messages, reports and suspensions

Messages and calls (where available) are end-to-end encrypted, so we can't read, see or hear them in normal use. If someone you talk to reports a message, their phone sends us a copy of what they report. You're responsible for what you send. Fluffer calls can't be used to reach emergency services; use your phone's regular dialer in an emergency.

Users can report messages, profiles and content. Profile pictures and reported pictures are checked automatically for known child sexual abuse material, matches are reported to the National Center for Missing & Exploited Children (NCMEC), and the account is suspended without notice or appeal.

We may remove content, limit features, or suspend or close accounts that break these terms or put people at risk. Some of this happens automatically:

When we suspend an account, we tell the account holder why and for how long, unless the law, a law enforcement request or someone's safety prevents it (for example, when we report child sexual abuse material). You can appeal each suspension once in the app. Appeals are reviewed against the recorded facts of the reports and the rules we applied.

Intimate images shared without consent. If an intimate image or video of you, or of someone you're authorized to act for (including an AI-generated or edited one), appears on Fluffer without consent, report it in the app or email takedown@fluffer.app. Include your signature (typed is fine), where it appears, and a short statement that it was shared without consent. You don't need a Fluffer account. We remove valid requests within 48 hours and make reasonable efforts to remove known copies. See our Safety page.

We may, but don't have to, monitor, review or remove content or accounts, and not acting on something doesn't mean we approve of it. We may preserve and disclose information when the law requires, to respond to valid legal process, or when we believe in good faith it's needed to prevent harm, including to children. We aren't involved in disputes between you and other users, viewers or developers, though we may help at our discretion.

#9. Your content

You own what you make. Your patterns, vibetracks, profile picture, reviews, Fluffer Audio takes and comments, and messages stay yours.

What you let us do with it. So Fluffer can work, you give us permission to store, copy and display your content, and to resize or reformat it, but only to run and secure Fluffer, fix problems, and show it to the people and apps you choose. This permission is worldwide and free, and doesn't stop you giving others permission too. If you make something public, such as a review, public profile, shared vibetrack or public take, we can show it publicly in Fluffer and on our websites. We'll ask before using your content in advertising. We don't use your private content for advertising, sell it, or use it to train AI.

When it ends. The permission ends when you delete the content or your account. It doesn't cover copies other people already have, records we must keep for legal or safety reasons, or backups until they expire.

You promise you have the rights to what you share and that it follows these terms. We don't check most content before it appears. Each person is responsible for what they share, so if you see something that breaks these terms, report it. Only add audiobooks and other files you have the right to use. Fluffer doesn't provide or license books from the catalogs it searches, and search results and covers belong to their owners.

#10. Third-party apps, the Remote API and AI features

Some apps and games in the Fluffer Store are made by other developers. They're their makers' responsibility, not ours, even though we may review them before listing. Their own terms and privacy notices may apply, and an app gets your information only if you allow it.

If you use the Remote API, MCP or other developer tools, code, scripts and AI assistants you connect act on your behalf. Whatever they do with your keys (including starting your toy) is treated as done by you, within the limits you set. Keep keys secret. We may change, rate-limit or turn off API access, and revoke keys we believe are compromised or misused. Developers who publish apps also agree to our Developer Terms. If they conflict with these terms, the Developer Terms control for developers, but they never limit section 17 for your personal use.

AI features (such as Felix, Vibe Market and Fluffer Audio timing) produce automated results that can be wrong, inconsistent or unexpected, including how much fuel a tip earns or how a toy responds. They're optional entertainment features. Don't rely on them for anything important.

#11. Our rights in Fluffer

Fluffer, its software and designs, the games we make, and the Fluffer and Motorbunny names and logos belong to us or our licensors. We give you a personal, non-transferable, revocable license to use Fluffer on devices you own or control, under these terms. If you send us feedback or ideas, we may use them without owing you anything. Chaturbate, Lovense, We-Vibe, OBS, Apple, Google and other names belong to their owners, and Fluffer isn't affiliated with or endorsed by them unless we say so.

#12. Changes to Fluffer and these terms

We're always working on Fluffer, so features may change or be removed, and some are offered as betas that may not work as expected. We may update these terms. If a change is material, we'll tell you in the app or by email at least 14 days before it takes effect, unless it's needed sooner for legal or safety reasons. Changes don't apply retroactively, and changes to section 17 are handled as section 17.9 describes. If you keep using Fluffer after a change takes effect, you accept it. If you don't agree, stop using Fluffer and delete your account.

#13. Ending your use

You can stop using Fluffer and delete your account at any time in Settings. We may suspend or close your account if you break these terms, if the law requires it, or if your account puts other people or Fluffer at risk. We may also stop offering Fluffer or a feature. When we can, we'll tell you first and give you time to save your things. If your account ends, end-to-end encrypted data that only your phones can unlock may become permanently inaccessible.

These parts still apply after your account ends: sections 4, 9 (for copies others already have and copies kept for legal or safety reasons), 11 (feedback), 13, 14, 15, 16, 17, 18 and 21.

#14. Disclaimers

Fluffer is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, and we don't promise that Fluffer will be uninterrupted, secure, error-free, compatible with your toy or phone, or that it will never lose data. We can't recover end-to-end encrypted data if you lose your key and your phones, so keep your own copies of anything important.

#15. Limits of our liability

To the fullest extent the law allows:

These limits apply to every legal theory, even if we were told the damage was possible. They don't limit liability for our gross negligence, willful misconduct or fraud, for death or personal injury where the law doesn't allow it to be limited, or any other liability that can't be limited by law. The limits are part of the bargain that lets us offer Fluffer for free. In plain terms: Fluffer is free, so if something goes wrong, our total responsibility to you is capped at $100, except where the law says it can't be.

If you live in New Jersey, the following parts of sections 4, 14 and 15 don't apply to you: [To be confirmed].

#16. Indemnity

To the extent the law allows, you will defend, indemnify and hold harmless MB Technologies LLC and its affiliates, officers, employees and agents from third-party claims, and related losses and reasonable legal fees, arising from your content; your stream and your use of tippers' or viewers' information; code, keys, AI assistants or apps you connect or publish; your breach of these terms or the law; or your violation of anyone's rights. This doesn't apply to claims you bring against us, or to the extent a claim results from our own breach, negligence or misconduct. We'll tell you promptly about any claim, may control its defense, and won't settle it in a way that admits fault for you without your consent.

#17. Disputes and arbitration

This section applies if you live in the United States. If you live elsewhere, you can use your local courts.

17.1 Talk to us first. Before starting arbitration or a court case, the person with a claim must send the other a written Notice of Dispute with their name, account email or username, a description of the claim and the relief they want, personally signed (a lawyer's signature alone isn't enough). Send yours to legal@fluffer.app or our mailing address; we'll send ours to your account email. If either side asks, we'll talk by phone or video within 60 days, and you may bring a lawyer. Neither side may start arbitration until 60 days after the Notice is received. Time limits for bringing claims are paused from the day the Notice is received until this process ends. A court may enforce this section, including by pausing or dismissing an arbitration filed without following it.

17.2 Agreement to arbitrate. You and MB Technologies LLC agree that any dispute, claim or controversy arising out of or relating to Fluffer, these terms or your relationship with us will be resolved only by binding individual arbitration, except as section 17.4 says. This covers claims based on contract, tort, statute, fraud, product liability, privacy or any other legal theory, and claims by or against our affiliates, officers, employees and agents. It doesn't cover a case already filed in court or arbitration before you first accepted this section. These terms involve interstate commerce, and this section is governed by the Federal Arbitration Act (9 U.S.C. §1 and following) and federal arbitration law, not state arbitration law.

17.3 Rules, fees and hearings. The American Arbitration Association (AAA) will run the arbitration under its Consumer Arbitration Rules and, where they apply, its Mass Arbitration Supplementary Rules (adr.org). If the AAA can't or won't, we'll agree on another provider, or a court will appoint an arbitrator under 9 U.S.C. §5. You pay no more than the consumer filing fee the AAA rules assign to you, and we pay all other AAA and arbitrator fees. If you show the arbitrator that you can't afford your share, we'll pay it. Each side pays its own lawyers unless the arbitrator awards fees under applicable law, and we won't seek our lawyers' fees from you unless the arbitrator finds your claim frivolous or brought for an improper purpose. If your claim is for US$25,000 or less, you choose whether it's decided on documents alone, by phone or video, or in person. An in-person hearing takes place in the county where you live unless we both agree otherwise. The arbitrator may award any individual relief a court could, but only for the person seeking it and only as needed for that person's claim.

17.4 Exceptions. Either of us may (a) bring an individual claim in small claims court if it qualifies and stays there, and (b) ask a court to stop infringement or misuse of intellectual property or unauthorized access to Fluffer. If the law doesn't allow a claim for public injunctive relief to be waived or arbitrated, a court decides that request only after the individual claims are decided in arbitration, and the court case is paused until then.

17.5 Who decides. The arbitrator decides all questions about the scope, validity and enforceability of this agreement to arbitrate, except that a court decides (a) the class and representative waiver in 17.6, (b) the procedures for many similar claims in 17.7, (c) whether 17.1 was followed, and (d) whether a change under 17.9 applies.

17.6 No class actions or jury trials. You and we may bring claims only individually, never as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not combine different people's claims (except as 17.7 allows) or award class-wide relief. If a court finds this paragraph unenforceable for a particular claim or remedy, only that claim or remedy is separated and goes to court, and it's paused until the arbitration ends. To the extent the law allows, you and we waive any right to a jury trial for any claim that goes to court.

17.7 Many similar claims. If 25 or more similar Notices of Dispute or arbitration demands are submitted by or with help from the same or coordinated lawyers or organizations, the AAA Mass Arbitration Supplementary Rules apply. The claimants' lawyers and we will each choose up to 10 cases (20 in all) to file and decide first, and the rest aren't filed, and no fees are due on them, until those are decided. Then both sides will mediate the remaining claims in good faith for up to 60 days, with us paying the mediator. Claims still unresolved may then be filed, and will proceed in batches of up to 100, each batch at the same time and with one arbitrator per batch where practical. Time limits for every claim covered by this paragraph are paused from receipt of its Notice of Dispute until it may be filed. A court may enforce this paragraph.

17.8 Opting out. You can opt out of this section within 30 days of first accepting these terms by emailing legal@fluffer.app or writing to our mailing address with your name, your account email or username, and the words "I opt out of arbitration." You don't need a lawyer, and opting out doesn't change the rest of these terms. If you opted out of an earlier version, that opt-out still applies.

17.9 Changes to this section. A material change to this section won't apply to a claim already described in a Notice of Dispute sent before the change takes effect. You can reject the change by emailing legal@fluffer.app within 30 days of its effective date, and then the version of this section you last accepted keeps applying to you.

17.10 Severability and survival. Except as 17.6 says, if any part of this section is found unenforceable, the rest still applies. This section survives the end of these terms and your account.

#18. Governing law and courts

These terms are governed by the laws of the State of New Mexico and the United States, without regard to conflict-of-law rules, and section 17 is governed by the Federal Arbitration Act. [To be confirmed] Any claim not subject to arbitration will be brought only in the First Judicial District Court for Santa Fe County, New Mexico, or the US District Court for the District of New Mexico, and you and we consent to their jurisdiction, except where the law where you live requires otherwise.

If you think content on Fluffer copies your work, send our copyright agent a notice with:

  1. your name and signature;
  2. the work you own;
  3. the content you say copies it, and where it is (a link or description);
  4. how to contact you;
  5. a statement that you believe in good faith the use isn't authorized;
  6. a statement, under penalty of perjury, that your notice is accurate and that you own the work or are authorized to act for the owner.

In Fluffer Audio you can also report from the app.

If we remove your content and you think it was a mistake, send our copyright agent a counter-notice with your name, address, phone number and signature; what was removed and where it was; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; and your consent to the jurisdiction of the federal court for your address (or, if you're outside the US, any district where we may be found) and to accept service from the person who complained. We'll pass it to them, and we may restore the content 10 to 14 business days after we receive it unless they tell us they've gone to court.

We close, in appropriate circumstances, the accounts of people who repeatedly infringe.

#20. Apple and Google

If you got Fluffer from Apple's App Store or Google Play, these terms are between you and us only, not Apple or Google, and we (not they) are solely responsible for Fluffer and its content. Your license to use the iOS app is limited to Apple-branded products you own or control, as the App Store's Usage Rules allow (Family Sharing users may also use it).

Apple has no obligation to provide maintenance or support for Fluffer. If Fluffer fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses from a failure to conform are our responsibility under these terms.

We, not Apple, are responsible for addressing any claims by you or a third party relating to Fluffer or your possession or use of it, including product liability claims, claims that Fluffer fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws. If a third party claims that Fluffer or your possession or use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.

You confirm that you aren't located in a country subject to a US government embargo or designated as "terrorist supporting", and that you aren't on any US government list of prohibited or restricted parties. Fluffer includes encryption and is subject to US export control and sanctions laws, so you may not use or export it in violation of them. You must follow applicable third-party terms (such as your mobile carrier's) when using Fluffer. Questions, complaints or claims: MB Technologies LLC, 530B Harkle Rd, Ste 100, Santa Fe, NM 87505, USA, (505) 501-7874, support@fluffer.app.

Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you. Otherwise, no one other than you and us has rights under these terms.

#21. General

These terms, the Privacy Policy, the Community Guidelines and any feature-specific terms we show you are the whole agreement between you and us about Fluffer. If any part is unenforceable, the rest still applies. If we don't enforce a term, we don't give up the right to later. You can't transfer these terms without our consent, and we may transfer them in a merger, acquisition or sale. Nothing in these terms creates a partnership or agency. We aren't liable for delays caused by events beyond our reasonable control. You agree to receive agreements, notices and other communications from us electronically, in the app or at your account email, and that they satisfy any legal requirement to be in writing.
